Terms & Conditions

  • Agreement
  • These terms and conditions (the “Terms”) apply between AfrAsia Bank Limited, a company incorporated under the laws of the Republic of Mauritius, with registration number C07067923 and having its registered office at Bowen Square, 10 Dr Ferriere Street, Port Louis, Republic of Mauritius (“AfrAsia”) and any person who registers, or for whom a third person registers, (the “Participant”) for the AfrAsia Bank Sustainability Summit 2019 organized by AfrAsia (the “Event”).
  • By registering for the Event, the Participant agrees to comply with and be bound by these Terms, AfrAsia’s Privacy Policy and Cookies Policy. If registration for a Participant is done by a third person, this third person confirms upon registering, that he or she is authorized to represent the Participant in entering into this agreement with AfrAsia. The Participant is considered to be bound by the Terms upon registration.
  • AfrAsia reserves the right to make changes to these Terms at any time. The most current version of the Terms is available on sustainabilitysummit.afrasiabank.com.
  • Registration
  • The Participant warrants that the information provided in the registration form is true and correct in all respects. Neither AfrAsia nor any of its directors, officers, employees or agents will hold any liability for allergies or information deemed relevant and which have not been communicated to AfrAsia.
  • If the Participant’s payment is successful, AfrAsia will immediately send a confirmation email to the email address specified by the Participant when registering for the Event (“Confirmation”).
  • Registration to the Event is on a ‘first come first served’ basis.
  • Participants will need to register their attendance to the Event at latest by 23:59 on 04 October 2019. Registrations after this time will only be accepted at the discretion of AfrAsia.
  • The Participant agrees to pay the Event registration fee within three [3] working days of registration, failing which, the Participant’s seat will not be guaranteed and may lead to the Participant being denied entry to the Event.
  • The Confirmation acts as a receipt for the transaction and can be used to redeem entry at the Event.
  • Provided that the registration fees have been duly cleared, the Confirmation is considered as giving the Participant a personal revocable license to attend the Event.
  • The Confirmation is for the personal use of the Participant who has registered to attend the Event or who has been designated upon registration as a Participant. Registrations may not be transferred to third persons under any circumstances, unless as expressly specified in these Terms.
  • The license granted with the Confirmation can be transferred to a third party only by effecting a replacement of the Participant with AfrAsia. All requests for replacement of any Participant must be made in writing to abss@afrasiabank.com and will only be accepted if made at least seven [7] days before the Event.
  • AfrAsia reserves the right to cancel any registration or refuse entry into the Event at any time, for any behaviour which AfrAsia deems unacceptable, for any breach of these Terms or the rules and regulations of the venue or any instructions or directions given to the Participant by any official at the Event.
  • Registration to the Event is non-refundable, unless as expressly specified in these Terms. 
  • Cancellations 
  • Cancellations of registrations are permitted twenty-eight [28] days or more in advance of the Event. AfrAsia regrets that no cancellations are acceptable after twenty-eight [28] days prior to the Event date, and therefore no refunds will be paid after this time. 
  • Changes to the Event
  • It may be necessary for reasons beyond AfrAsia’s control to alter the advertised content, timing and/or location of the Event or advertised speakers or to cancel the Event. AfrAsia reserves the right to take these actions at any time without any liability whatsoever to the Participant for any damages, expenses, losses or costs incurred by the Participant as a result.
  • Where circumstances force cancellation of the Event in its entirety, AfrAsia will offer a full refund to each Participant within fourteen [14] days of the cancellation of the Event.
  • AfrAsia is not liable to the Participant for fees, travel, accommodation, or other costs and expenses if AfrAsia is required to cancel or modify the Event as a result of an event outside of its control. This includes, but is not limited to, acts of God, floods, lightning, storm, fire, explosion, military operations, war, acts of terrorism, or threats of such acts, any strike action, lock-outs, or widespread illness or force majeure.
  • Intellectual property
  • All rights in all presentations, documentation and materials published or otherwise made available as part of the Event (including but not limited to any presentations or audio or audio-visual recording of the Event) (“Content”) are owned by AfrAsia or are included with the permission of the owner of the rights. The Participant shall not distribute, reproduce, modify, store, transfer or in any other way use any of the Content for commercial reasons or in any way that might infringe third party rights or that may bring AfrAsia or any of AfrAsia’s affiliates into disrepute.
  • The Content does not necessarily reflect AfrAsia’s views or opinions.
  • AfrAsia has taken reasonable care to ensure that the Content created by it is accurate and complete, however, some of it is supplied by third parties and it is unable to check its accuracy or completeness. The Participant should verify the accuracy of any information (whether supplied by AfrAsia or third parties) before relying on it. The Content is provided on an “as is” basis without any warranties of any kind (express or implied). AfrAsia hereby excludes to the fullest extent permitted by law all liabilities, costs, claims, damages, losses and/or expenses arising from any inaccuracy or omission in the Content or arising from any infringing, defamatory or otherwise unlawful material in the Content.
  • To the extent that any Content is made available on AfrAsia’s website or any other online channels, AfrAsia reserves the right to suspend or remove access to such Content at any time.
  • Compliance with rules
  • The Participant must abide by the rules and regulations of the venue which are available at the venue and may be changed at the venue’s discretion and any other rules or regulations which may be brought to the attention of the Participant.
  • The Participant must comply with all reasonable safety and other announcements and/or directions whilst attending the Event.
  • Accommodation and transport
  • The registration fee does not include accommodation or transport to and from the Event. AfrAsia does not make transport or accommodation arrangements for the Participant nor reimburse the respective expenses. All transport and accommodation arrangements are on the responsibility and cost of the Participant.
  • A list of suitable hotels within the vicinity can be found in the description page.
  • AfrAsia is not responsible for the granting of any visas that are required to attend the Event. Failure to receive a visa does not constitute a basis for any refund of registration fees.
  • Refreshment & Lunch 
  • Refreshments are included in the registration fee. Where lunch is provided, there will be a vegetarian option. If the Participant has any other dietary requirements or would like to discuss any access or specific requirementsthe Participant may have, the Participant must contact AfrAsia at the time of booking. Neither AfrAsia nor any of its directors, officers, employees or agents will hold any liability for allergies or information deemed relevant and which has not been communicated.
  • Speakers
  • Views expressed by speakers are their own. AfrAsia disclaims any liability for any advice given, or views expressed, by any speaker at the Event or in any documentation provided to the Participants.
  • Filming & photography
  • By attending the Event, the Participant consents to the following:
  • film, photograph and sound recordings may be made at the Event, and they may also feature the Participant. The Participant consents to all uses of such photographing and recordings; and
  • the Participant will refrain from unauthorized use of photographic and recording equipment at the Event as such use is prohibited.
  • Delegate access
  • AfrAsia makes every effort to ensure that its events are accessible and enjoyable for all its delegates, so if the Participant requires any particular assistance, the Participant must inform AfrAsia as soon as possible so that AfrAsia can make the necessary arrangements.
  • Data protection & privacy
  • This section applies to any information acquired by and/or provided to AfrAsia including, but not limited to, the Participant’s name, title, company information, any other information provided through use of this website; information provided during the course of orders, transactions and bookings; information provided through enquiries or by the completion of any request and or invitation for information (Data). AfrAsia will collect Data about the Participant when the Participant uses this website.
  • The Participant consents to the collection, storage and processing of Data in the manner described in this section. The Participant’s continued use of this website constitutes the Participant’s agreement to any changes to the website’s terms and conditions of use.
  • The Participant consents to AfrAsia sharing Data with other Participants at the Event and with Alentaris Ltd, for the processing of payments by Participants. 
  • In no event will AfrAsia be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of the registration page hosted by Google LLC or its agents, or incurred as a consequence of security risks or for any related acts or omissions on the part of Google LLC or its agents.
  • AfrAsia will only store Data as long as required to fulfil the purpose for which a Participant made it available to AfrAsia. Subject to applicable law, a Participant has the right to demand the erasure, rectification or variation of stored Data. 
  • A Participant has the right, under certain conditions, of restricted processing of their Data and to object to any processing of their Data. 
  • A Participant has the right to demand information pertaining to any of their Data. 
  • A Participant has the right to withdraw their consent to the use of any Data at any time and without any reason. 
  • A Participant also has the right to lodge a complaint with the Data Protection Commissioner. 
  • If a Participant wants to update or delete Data, or to revoke any given consent, the Participant must contact AfrAsia’s data protection officer at DPO@afrasiabank.com.
  • Liability
  • AfrAsia’s aggregate liability to the Participant, whether such liability arises in contract, tort (including negligence) or otherwise, for any damages, loss, costs, claims or expenses of any kind howsoever arising, out of in connection with any booking (or requested booking) made by the Participant or otherwise in relation to the Event, shall be limited to the price paid by the Participant in respect of the Participant’s registration to attend the Event.
  • AfrAsia shall not be liable to the Participant for (i) any loss of profit, loss of or damage to data, loss of anticipated savings or interest, loss of or damage to reputation or goodwill or; (ii) any indirect, special or consequential damages, loss, costs, claims or expenses of any kind.
  • The Participant agrees to indemnify AfrAsia, its staff and affiliates and to hold AfrAsia harmless to the fullest extent permitted by law, against all loss, costs, claims or expenses of any kind arising from any act or omission by the Participant (including the Participant’s attendees) during or otherwise in relation to the Event.
  • Third party sites 
  • Your registration to the Event is via a website hosted by “Google LLC”. 
  • AfrAsia is not responsible for the content, products or services available from this website or links displayed on this website. Each Participant acknowledges sole responsibility for their use of any third-party websites, services and acknowledge such use is subject to any terms of use of those websites or services.
  • Governing law and jurisdiction
  • These Terms are construed in accordance with and governed by the laws of the Republic of Mauritius.
  • Any dispute, controversy or claim arising under these Terms or in connection with the Event or registration to the Event is subject to the exclusive jurisdiction of the courts of Mauritius.
